By becoming a member of FIRE & ICE SPIRIT SPA (The SPA), I agree to the following terms and conditions:

1. The SPA’s purpose is furthering the upliftment, enlightenment, spiritual realization, and general welfare of its members.

2. The SPA is a creation of free men and women to associate with each other in the private domain according to their ministry and talents.

3. The SPA is a platform on which members may, for The SPA’s good purpose, conduct all manner of private speech and business with The SPA, members, and other associations – keeping all business in the private domain and utilizing the protections thereof.

4. The SPA is a private, unincorporated ministry that operates outside the jurisdiction of government entities, agencies, officers, agents, contractors, and other representatives, as protected by law.

5. The SPA lawfully stands on the authority our Creator gives to free men and women as revealed in the holy Scriptures, the Constitution of the United States of America, the constitutions of the several states of the union, and the Charter of Rights of Canada.

6. Members claim the right to book and pay for use of the SPA facilities, purchase discount passes and book private use of the SPA where they may invite non-members. Members assume full responsibility to ensure all of their non-member guests abide by SPA Guidelines and protocols.

7. Members claim the right to freedom of religion, free speech, petition, assembly, and the right to gather in association to assert our rights protected by those Constitutions, Charter, and Statutes and the right to be free from unreasonable search and seizure, the right to not incriminate ourselves, and the right to freely exercise all other unalienable rights as granted by our creator, our almighty God, and guaranteed by those Constitutions, Charter, and Statutes.

8. Members decide for themselves which member(s) qualify to provide them counsel and advice concerning all matters, including but not limited to, physical, spiritual, healthcare, law, and any other matter, and may contract for counsel, advice, services, etc. they believe assist them through The SPA.

9. Members have the freedom to choose and perform for themselves the types of therapies and treatments they think best for diagnosing, treating, and preventing illness and disease and for achieving and maintaining optimum wellness, as well as the freedom to choose any types of assistance in lawful matters and any other private business activity.

10. The SPA will recognize as a member any person(s), natural or otherwise (irrespective of race, color, or religion) who has joined FIRE & ICE SPIRIT SPA and has agreed to the terms of membership, providing said person has not been sanctioned, exercised, or otherwise banned by The SPA.

11. The SPA’s Trustees, or their designee, may, at any time, terminate my membership without reimbursement should they conclude I am interacting with them or other members in a way that is contrary or detrimental to the focus, principles, and betterment of The SPA.

12. The SPA is protected by the First and Fourteenth Amendments to the U.S. Constitution and outside the jurisdiction and authority of Federal and State Agencies and Authorities concerning complaints or grievances against The SPA, members, or other staff persons. All rights, complaints or grievances will be settled by a The SPA designee, committee, or tribunal and will be waived by the member for the benefit of The SPA and its members.

13. The SPA and member activity is under common law rather than statutory law or regulatory law, which are creations of public government for the public.

14. In my relations as member, I voluntarily change my capacity from that of a public person to that of a private member.

15. My activities within The SPA are matters of private contracts that I refuse to share with Local, State, or Federal investigative or enforcement agencies. I agree not to pursue legal action against a fellow member of The SPA unless that member has exposed me to a clear and present danger of substantive evil and upon the recommendation and approval of The SPA.

16. I do not, and will not while a member, represent any Local, State or Federal agency whose purpose is to regulate and approve products or services or to conduct any mission of enforcement, entrapment, or investigation.

17. I may, by written notice to The SPA, withdraw from this agreement and terminate membership at any time. I will not misrepresent myself as being a member beyond the term of my membership.

18. The SPA may revoke my membership if I, or any of my non-member guests, violate spa guidelines or protocols or engage in abusive, violent, menacing, destructive or harassing behavior towards any other member or representative of The SPA.

19. These pages, the Member Sovereign Declaration and Assumption of Risk, Release and Indemnity Agreement and Spa Guidelines consist of the entire agreement for membership in The SPA.

20. I enter into this agreement freely, without duress or coercion.

21. I hereby exercise my right of “freedom of association” as guaranteed by the Universal Declaration of Human Rights (UDHR), the U.S. Constitution, and equivalent provisions of the various State Constitutions, as well as the Charter of Rights of Canada.

22. I agree this contract began on the date of my joining The SPA. I declare that by joining The SPA and/or The SPA’s websites and/or social media group(s), I have carefully read this document and I understand and agree with it.

Fire & Ice Spirit Spa Environment: Spa activity is restricted to the registration area, pool area, massage gazebo, fire pit area, toilets and parking area. Wandering around the grounds, gardens and residence is strictly forbidden without an invitation.

Devices, Vibe & Privacy: To respect the privacy of all users we ask that phones and cameras not be used in the spa space. Please leave your personal devices in the provided cubby, in your vehicle or, if absolutely necessary, with you but switched to silent mode AND do-not-disturb. For consideration of all members, please silence all cellular phones before entering the spa. Thank you in advance for speaking softly while within the spa.

Spirit Spa Time Blocks

Sessions will be opened in blocks of 2 hours. Please respect these blocks and leave spa area when it closes. Please leave Church property within 15 minutes of spa closing. The Spa reserves the right to change time block offerings as needed at any time.

Right to Refuse Service

We reserve the right to refuse or discontinue service to anyone demonstrating behavior that is perceived to be inappropriate or disruptive to our membership base and atmosphere.

Prices

Member prices and services are subject to change at any time.

Gift Cards

Gift cards are sold in $25 increments. Gift cards are not refundable or redeemable for cash.

Nudity

While we deeply honour the human body in all its beauty we ask members and non-member guests to remain clothed while at the Spirit Spa unless the spa is hosting a special clothing optional event or private booking.

Pets

We love pets but for health and safety reasons and in order to respect the restorative spirit of the spa pets are not permitted.

Children

To ensure the safety of children and the enjoyment of all members, we ask that parents or guardians make other arrangements for their children while they are enjoying the spa. Children must be 12 or older to be members of the spa and must be accompanied by an adult at all times until the age of 18. Children of all ages are welcome as non-member guests to private bookings. Children must abide by all spa rules and guidelines.

Food/Beverages

Refreshments are available and provided for you to purchase and enjoy before and after your service(s). We have a catering menu for you to choose from should you wish to have refreshments. Please inform us if you have specific dietary needs when joining or ordering any food or beverages. Members are encouraged to bring their own water bottles and to drink regularly.

Accessibility

The spa grounds are handicap-accessible and can accommodate wheelchairs, however, mechanical lifts are not available for the pools or sauna. Attendants are not allowed to lift people into and out of pools etc. If such assistance is required, please bring a personal care attendant. A Handicap- accessible restroom is available.

Safety

There are no lifeguards on duty. Swim in pools and use plunge and sauna at your own risk based on your own ability. No diving whatsoever is allowed in hot tub or shallow end of the pool. Please do not bring glass into pool area. Be mindful of recommended time limits in cold plunge, hot tub & sauna and respect your physical limits based on your own health, chance of pregnancy etc.

Drugs, Smoking and Alcohol

While we respect plant medicine like tobacco, rape and marijuana all such use and the use of alcohol is strictly forbidden on property. Members agree not to consume or arrive to the spa under the influence of any of drugs or alcohol.

Payment/Deposits

We accept Cash, Venmo, Paypal and most credit cards. All reserved seasons will be charged to members whether member uses the session or not.

Reservations

Spots are limited in each Time Block so reservations are highly recommended in order to avoid disappointment.

Cancellations

A credit card, venmo or paypal is required to reserve all appointments online.

Due to limited space, spa members must provide 24 hour cancellation notice in order to receive a full refund.

Use of massage gazebo

Massages can be arranged through the Spa or the gazebo can be rented by Fire & Ice Spirit Spa Members. Any body workers Spa Members invite on property will need to sign a non-member sovereign declaration and assumption of risk, release and indemnity agreement to gain entrance. They will be considered your responsibility as a non-member guest. They will not be permitted to use any of the other spa facilities with the exception of the toilet.

We respect the privacy of our email subscribers. It is our policy:

• To respect the purpose for which our site visitors and others gave us email information. We give users choice and consent over how their personal information is used, and remove names immediately upon request.

• To not sell, rent or loan our subscriber or customer lists to third parties for email, direct marketing or other purposes. We never allow third parties any other use of these subscriber lists.

MEMBER SOVEREIGN DECLARATION AND ASSUMPTION OF RISK, RELEASE AND INDEMNITY AGREEMENT

PLEASE READ THIS ENTIRE FORM CAREFULLY BEFORE SIGNING. THIS FORM INCLUDES AN ASSUMPTION OF RISK AND RELEASE OF THE ORGANIZERS, LANDLORDS, CHURCH, HOSTS, MEMBERS OR VOLUNTEERS AND ITS BOARD MEMBERS, EMPLOYEES, AGENTS AND VOLUNTEERS OF FIRE & ICE SPIRIT SPA.

In consideration of being allowed to participate in any way in the FIRE & ICE SPIRIT SPA, related events and activities I, being at least 18 years of age, for myself, my heirs, assigns and legal representatives, or if applicable, for my minor child or ward, his or her heirs, assigns and legal representatives, agree to the following:

Assumption of Risk: I understand and acknowledge that I, or my minor child or ward, by participating in FIRE & ICE SPIRIT SPA and related events, may be engaging in dangerous activities and may expose me, or my minor child or ward, to a variety of foreseen and unforeseen hazards and risk. I acknowledge that these activities are a test of a person’s physical and mental limits, are strenuous and dangerous and require a certain degree of physical condition, ability, maturity, and skill and involve risk of serious injury, including permanent disability or death, social and economic losses, and property damage. I understand that these injuries might result not only from my own actions, inactions, or negligence, but also from the actions, inactions, or negligence of others, or the condition of the terrain, natural and manmade hazards and obstacles, facilities, equipment or vehicles. I choose to voluntarily participate (or allow my child to participate) despite all risks. I assume all inherent and other risks and accept responsibility for any property damage and loss, and for any personal injury, illness, disability, emotional distress, and death that I (or my child) may suffer whether described in this document or not.

I have been given the opportunity to ask questions of appropriate FIRE & ICE SPIRIT SPA representatives concerning such risks and hazards and acknowledge that any questions have been satisfactorily answered. I have received sufficient information and time to make an informed decision about my (or my minor child’s or ward’s) participation in the activities. I acknowledge that I am solely responsible for determining my (or my child’s) suitability to participate. I certify that I am physically fit, have sufficiently prepared for participation in the spa and have not been advised otherwise by a qualified medical person. I do have (or my child has) the requisite skills, qualifications, physical and mental ability, and training necessary to properly and safely participate.

Waiver and Release: I, (and on behalf of my minor child or ward) agree to forever release and discharge FIRE & ICE SPIRIT SPA and agree not to sue the organizers, landlords, church, hosts, members or volunteers for any and all liability or claims I, or my minor child or ward, might have against the organizers, landlords, church, hosts, members or volunteers and its board members, employees, agents and volunteers as a result of injury, permanent disability, death, social and economic losses, and property damage incurred related to my (or my minor child or ward’s) participation in the activities including any required training programs or use of any equipment or facilities. I understand that this release discharges organizers, landlords, church, hosts, members or volunteers of FIRE & ICE SPIRIT SPA from any liability or claim that I, or my minor child, may have against them with respect to any bodily injury, personal injury, illness, death, property damage, or property loss that my result from the activities, whether caused by the negligence of organizers, landlords, church, hosts, members or volunteers of FIRE & ICE SPIRIT SPA or otherwise. This waiver and the release of liability shall be construed broadly to provide a release and waiver to the maximum extent permissible under law.

Indemnity: I agree to defend, indemnify (meaning to pay or reimburse any amount required to be paid, including attorney’s fees) and hold the organizers, landlords, church, hosts, members or volunteers of FIRE & ICE SPIRIT SPA harmless from all liability from all claims, causes of action, injury, death, loss (including attorneys’ fees and costs) or damage to person or property, including rental or loaned equipment, personal injury, liability, losses, damages, judgments, or expenses, disability, death or other loss brought by or on behalf of me (or my minor child or ward), a family member, my estate, another participant or spectator, or any other person arising from or relating to my (or my minor child or ward) participating in the activities of FIRE & ICE SPIRIT SPA, including claims of negligence.

I further consent and authorize organizers, landlords, church, hosts, members or volunteers of FIRE & ICE SPIRIT SPA to obtain medical treatment on my behalf if I am injured or require medical attention during my participation at the SPA and which may be deemed advisable in the event of injury, accident and/or illness during my time at the SPA. I understand and agree that I am solely responsible for all costs related to such medical treatment, medical transportation, and/or evacuation. I release, forever discharge, and hold harmless organizers, landlords, church, hosts, members or volunteers of FIRE & ICE SPIRIT SPA from any claim whatsoever in connection with such treatment and other medical services.

It is my intent to bind myself, my heirs, executor, administrators, legal representatives and assigns (or my minor child or ward and their heirs, executor, administrators, legal representatives and assigns). I agree that this Release represents the full understanding between the organizers, landlords, church, hosts, members or volunteers of FIRE & ICE SPIRIT SPA and supersedes all other prior agreements, understandings, representations, and warranties, both written and oral, between us, or my minor child or ward, with respect to the subject matter thereof. If any term or provision of this Release shall be held to be invalid by any court of competent jurisdiction, that term or provision shall be deemed modified so as to be valid.

I agree that the substantive laws of Nature and Nature’s God (but not any law that would apply the laws of any state, government or region) govern this Agreement and any dispute I (or my child has) with the organizers, landlords, church, hosts, members or volunteers of FIRE & ICE SPIRIT SPA. Any portion of this Agreement deemed unlawful or unenforceable is severable and shall be stricken without effect on the enforceability of the remaining provisions.

I have read this Agreement, I understand its contents and I sign it voluntarily. I intend by this Agreement to assume all hazards and risks, waive all rights to sue and release all liabilities and claims, and indemnify the organizers, landlords, church, hosts, members or volunteers of FIRE & ICE SPIRIT SPA for any claims arising from my (or my minor child or ward’s) participation in the activities. I understand that this Agreement has no expiration date and remains in effect at all times that I am (or my minor child or ward is) at the SPA and will be binding on me, my family members, heirs, assigns, executors, representatives, and estate.
