Practitioner Member Application

Please fill out your contact details and information about the offering(s) you are looking to share with the community. While our main calling is to create space for sharing, we also create with the intention that offerings are in alignment with our mission, values and beliefs.

  • By becoming a PRACTITIONER MEMBER of NATURE’S CHURCH, I agree to the following terms and conditions:

    1. NATURE’S CHURCH’s purpose is furthering the upliftment, enlightenment, spiritual realization, and general welfare of people throughout the world, the betterment of life on planet Earth, and other spiritual, humanitarian, and beneficent purposes.

    2. NATURE’S CHURCH is a creation of free men and women to associate with each other in the private domain according to their ministry and talents.

    3. Practitioner members acknowledge they have read the mission, vision and values (hereafter known as MVV) of NATURE’S CHURCH and agree to conduct themselves in a manner that is in alignment with the MVV of NATURE’S CHURCH and limit their use of space at NATURE’S CHURCH to the activities and offerings listed in their online application (will be inserted here from this form):

    4. NATURE’S CHURCH is a private, unincorporated ministry that operates outside the jurisdiction of government entities, agencies, officers, agents, contractors, and other representatives, as protected by law.

    5. Practitioner members claim the right to use specific church premises during specified times to bring forward the offerings discussed during the application process. Premise availability is subject to change at the sole discretion of Nature’s Church.

    6. My practitioner membership renews annually and automatically upon receipt of an annual $44 donation to Nature’s Church.

    7. NATURE’S CHURCH will recognize as a practitioner member any person(s), natural or otherwise (irrespective of race, color, or religion) who has joined NATURE’S CHURCH and has agreed to the terms of practitioner membership, providing said person has not been sanctioned, exercised, or otherwise banned by NATURE’S CHURCH.

    8. NATURE’S CHURCH’s trustees, or their designee, may, at any time, terminate my membership should they conclude I am interacting with them or other members or the community in a way that is contrary or detrimental to the focus, principles, policies, valued and betterment of NATURE’S CHURCH.

    9. NATURE’S CHURCH is protected by the First and Fourteenth Amendments to the U.S. Constitution and outside the jurisdiction and authority of Federal and State Agencies and Authorities concerning complaints or grievances against NATURE’S CHURCH, members, or other staff persons. All rights of complaints or grievances will be settled by a NATURE’S CHURCH designee, committee, or tribunal and will be waived by the practitioner member for the benefit of NATURE’S CHURCH and its members.

    10. NATURE’S CHURCH and practitioner member activity is under common law rather than statutory law or regulatory law, which are creations of public government for the public.

    11. I understand that becoming a practitioner member is not the same as becoming a formal member of NATURE’S CHURCH and does NOT on its own constitute assuming any share of responsibility or liability on behalf of NATURE’S CHURCH.

    12. I acknowledge that I am sovereign, responsible for myself, and as such WAIVE LIABILITY and ASSUME RISK for use of premises as follows:

    12(a). In consideration of my use of the premises of 4470 Wailapa Road, Kilauea, County of Kauai, Hawaii, I for myself, my heirs, personal representatives or assigns, employees, guests, clients, attendees, volunteers, vendors do hereby assume all risk of harm resulting from the use of facilities and release, waive, discharge, and covenant not to sue the church, trustees, directors, officers, ministers, members, employees, agents and landlords from liability from any and all claims including negligence resulting in personal injury, accidents, or illnesses (including death) and property loss arising from use of premises. The use of said land and facilities will be at my sole risk. I assume FULL responsibly and liability for everyone I invite onto the property. It is my responsibility to indemnify myself by having all representatives or assigns, employees, guests, clients, attendees, volunteers, vendors, etc. sign waivers of liability.

    12(b) Use of premises carries with it certain inherent risks that cannot be eliminated regardless of the care taken to avoid injuries. I have read the previous paragraph and I know and understand risks are inherent in the activity I am organizing. I hereby assert that my use of premises is voluntary and that I knowingly assume all such risks. I acknowledge that it is my responsibility to ensure all representatives, employees, guests, attendees, volunteers, vendors, etc. are fully informed of all risks.

    12(c) I also agree to indemnify and hold harmless the church, trustees, directors, officers, ministers, members, employees, agents and landlords from any and all claims, actions, suits, costs, expenses, damages and liabilities including attorney fees as a result of this use of premises.

    12(d) The undersigned further expressly agrees that the forgoing waiver and assumption of risk agreement here in section 12 of this application is intended to be as broad and inclusive as is permitted by the law Nature and Nature’s God and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.

    12(e) I have read section 12 of the application as a waiver of liability, assumption of risk, and indemnity agreement, and fully understand its terms. I acknowledge that I am signing the agreement freely and voluntarily, and intend by my initials and signature below to be a complete and unconditional release of all liability to the greatest extent allowed by law.

    13. I assume full responsibility for all guests, clients, visitors and persons I invite onto the premises. I acknowledge that it is my responsibility to have all guests, clients, visitors and persons I invite sign an Assumption of Risk, Release and Indemnity Agreement Waiver.

    14. I do not, and will not while a practitioner member, represent any Local, State or Federal agency whose purpose is to regulate and approve products or services or to conduct any mission of enforcement, entrapment, or investigation.

    15. I may, by written notice to NATURE’S CHURCH, withdraw from this agreement and terminate my practitioner membership at any time. I will not misrepresent myself as being a church member or being a practitioner member beyond the term of my membership.

    16. NATURE’S CHURCH may revoke my practitioner membership if I engage in abusive, violent, menacing, destructive or harassing behavior towards any member of NATURE’S CHURCH or the larger community.

    17. These pages consist of the entire agreement for practitioner membership in NATURE’S CHURCH.

    18. I enter into this agreement freely, without duress or coercion.

    19. I hereby exercise my right of “freedom of association” as guaranteed by the Universal Declaration of Human Rights (UDHR), the U.S. Constitution, and equivalent provisions of the various State Constitutions, as well as the Charter of Rights of Canada.

    20. I agree this contract began on the date of my joining NATURE’S CHURCH as a practitioner member. I declare that by joining NATURE’S CHURCH as a practitioner member, I have carefully read this document and I understand and agree with it.

  • Environment: Member activity is restricted to the registration area, pool area, massage gazebo, fire pit area, toilets and parking area. Wandering around the grounds, gardens and residence is strictly forbidden without an invitation.

    Devices, Vibe & Privacy: To respect the privacy of all users we ask that phones and cameras not be used in the spa space. We make an exception for practitioners while giving treatment so phones can be used for music and timers.

    Time Blocks

    Please respect the blocks booked and finish early if you began your session late if others are waiting. Please leave Church property within 15 minutes of treatment completion. The Spa reserves the right to change time block offerings as needed at any time.

    Right to Refuse Service

    We reserve the right to refuse or discontinue service to anyone demonstrating behavior that is perceived to be inappropriate or disruptive to our membership base and atmosphere. We reserve the right to deny member access for treatments and services offered that were not disclosed at time of joining.

    Prices

    Member prices and services are subject to change at any time.

    Nudity

    While we deeply honour the human body in all its beauty we ask members and non-member guests to remain clothed while on premises. Naturally the exception is made while clients are receiving massages. Watsu clients are to remain in bathing attire.

    Pets

    We love pets but for health and safety reasons and in order to respect the restorative spirit of the spa pets are not permitted.

    Children

    To ensure the safety of children and the enjoyment of all members, we ask that parents or guardians make other arrangements for their children while they are offering services on premises.

    Accessibility

    The spa grounds have a handicap-accessible washroom and is somewhat accessible but there is a step into the massage gazebo and mechanical lifts are not available for the hot tub. Attendants are not allowed to lift people into and out of pools etc. If such assistance is required, please bring a personal care attendant for the client or ensure you are able to manage their needs yourself.

    Safety

    There are no lifeguards on duty. Swim in pools and use plunge and sauna at your own risk based on your own ability. No diving whatsoever is allowed in hot tub or shallow end of the pool. Please do not bring glass into pool area. Be mindful of recommended time limits in cold plunge, hot tub & sauna and respect your physical limits based on your own health, chance of pregnancy etc.

    Drugs, Smoking and Alcohol

    While we respect plant medicine like tobacco, rapé and marijuana all such use and the use of alcohol is strictly forbidden on property. Members agree not to consume or arrive to the spa under the influence of any drugs or alcohol.

    Payment/Deposits

    We accept Cash, Venmo, Paypal and most credit cards. All reserved seasons will be charged to members whether member uses the session or not.

    Cancellations

    A credit card, venmo or paypal is required to reserve all appointments online.

    Due to limited space, members must provide 24 hour cancellation notice in order to receive a full refund.

    Use of massage gazebo

    Sheets must be used on massage tables at all times. Members are expected to bring their own oil and massage table sheets and leave the space as they found it. Sheets are available for rent and oil for purchase if needed.

    Waivers

    Members need to have all clients, guests and visitor they invite on property sign an assumption of risk, release and indemnity agreement to gain entrance. They will be considered your responsibility as a non-member guest. They will not be permitted to use any of the other spa facilities with the exception of the toilet without purchasing a spa pass.

    Gratuity

    A gratuity box is located in the massage gazebo for your convenience.
